Terms of Service

1. Who we are

Hyper-Visuals is a brand operated by Discoverr Global (“we”, “us”, “our”), a company registered in India. “You” means the person or organisation using the Site or our services.

2. Our services

We provide done-for-you visual content production (“Hyper-Visuals”) — turning long-form content into single-page visual assets — along with a free newsletter and related content. The exact scope, deliverables, timeline, and fees of any paid engagement are agreed with you separately (for example, in a proposal or during a discovery call).

3. Engagements & quotes

Prices shown or discussed are indicative until confirmed in a written proposal or invoice. An engagement begins when you accept a proposal and/or pay any deposit required. We may decline or discontinue work at our discretion, subject to the refund terms below.

4. Payment

Fees, deposits, and payment schedules are set out in your proposal or invoice. Payments are processed by a third-party payment provider. Unless stated otherwise, invoices are due on receipt, and work may pause if payment is overdue. Cancellations and refunds are governed by our Cancellation & Refund Policy.

5. Your responsibilities

• Provide the source content, materials, and information we need, on time and accurately;
• Ensure you have the rights to any content you give us, and that our use of it will not infringe anyone’s rights;
• Review and give feedback on deliverables within agreed windows.

6. Intellectual property

On full payment for an engagement, you receive the rights to the final deliverables agreed for your project, for the purposes contemplated in that engagement. We retain ownership of our pre-existing methods, templates, know-how, and tools, and of the Hyper-Visuals brand, name, logo, and Site content.

Unless you tell us otherwise in writing, we may display completed work and reference your name and logo as part of our portfolio, case studies, and marketing.

7. Acceptable use

You agree not to misuse the Site — including by attempting to disrupt it, access it without authorisation, scrape it at scale, or use it for unlawful purposes.

8. Disclaimers

The Site and our content are provided “as is”. While we work to a high standard, we do not warrant specific results, engagement levels, or business outcomes from any deliverable. To the fullest extent permitted by law, we disclaim implied warranties.

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising from an engagement will not exceed the fees you paid us for that engagement, and we will not be liable for indirect, incidental, or consequential losses.

10. Indemnity

You agree to indemnify us against claims arising from content you provide to us or from your breach of these terms.

11. Termination

Either party may end an engagement in writing. Fees for work completed up to termination remain payable, subject to the Cancellation & Refund Policy.

12. Governing law

These terms are governed by the laws of India. The courts at Indore, Madhya Pradesh, India will have jurisdiction, subject to any mandatory consumer-protection rights you have where you live.

13. Changes

We may update these terms from time to time; the “last updated” date reflects the latest version. Continued use of the Site means you accept the updated terms.
